These Booking Terms (these “Booking Terms”) apply to each booking and are accepted at checkout, in addition to our Terms of Use and Privacy Policy. In these Booking Terms, “Explore Dunya”, “we”, “us” and “our” refer to Explore Dunya, and “Supplier” means the independent third party that provides the experience, tour or activity (the “Experience”) you are booking. These Booking Terms confirm, at the point of purchase, that your contract for the Experience is formed with the Supplier that provides it.
1.1 By completing this booking, you enter into a contract for the Experience directly with the Supplier that provides it. Explore Dunya acts solely as the Supplier’s disclosed agent to take the booking and to collect payment on the Supplier’s behalf. Explore Dunya is not the provider of the Experience and is not a party to your contract with the Supplier for the Experience itself.
2.1 The particulars of your booking, being the Experience, the date and time, the participants, the price, the inclusions and the meeting point, are as displayed at checkout and in your confirmation. You must review these particulars carefully before payment, and you are responsible for the accuracy of the details you enter (including the activity date and participant information).
2.2 The Supplier’s listing sets out the requirements and inherent risks of the Experience (including any minimum age, health, fitness or skill requirements). By completing this booking, you confirm that you and each member of your party satisfy those requirements and accept those risks.
3.1 The total amount displayed is charged at the time of booking to your payment method. Explore Dunya collects that amount on the Supplier’s behalf. Your booking is confirmed only upon our issue of a confirmation.
4.1 This booking is subject to the Supplier’s cancellation policy displayed at checkout. Where you are entitled to a refund under that policy or by law, we shall process it on the Supplier’s behalf to your original payment method. Where the Supplier cancels or materially changes the Experience, you are entitled to the remedies set out in the Supplier’s policy and under applicable consumer law, which may include a refund. Nothing in the Supplier’s cancellation policy limits your rights under the Australian Consumer Law or other applicable law.
5.1 You must arrive punctually at the stated meeting point, bring any required documents, comply with the Supplier’s reasonable safety instructions, and refrain from participating while impaired or unfit. The Supplier may refuse participation, without refund, where you do not satisfy the stated requirements or would endanger yourself or others. Certain Experiences require you to sign the Supplier’s own risk acknowledgement or waiver on the day, which is a matter between you and the Supplier.
6.1 Nothing in these Booking Terms operates to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law, including in respect of death or personal injury caused by negligence to the extent the law does not permit such exclusion.
6.2 Subject to clause 6.1, and because the Experience is provided by the Supplier and not by Explore Dunya, any claim relating to the Experience itself, including any injury, illness, death, loss or damage occurring during or in connection with the Experience, lies against the Supplier that provided it. The responsibility of Explore Dunya is limited to the provision of the booking service, and any liability we may have in respect of that service is limited as set out in our Terms of Use.
7.1 These Booking Terms apply together with our Terms of Use and Privacy Policy. We record the version of these Booking Terms accepted by you and the date and time of acceptance in connection with your booking.
